Rules and Regulations of
Arapahoe Ridge
Pursuant to Article 8.15 of Declaration of
Covenants, Conditions and Restrictions for Arapahoe Ridge[1], the Board of Directors adopts by resolution the
following Rules and Regulations 4.01 4.07 this 15th day of June 2004.
These Rules and Regulations may be amended by majority of a vote by Board of
Directors provided there is a quorum present, or by a majority vote of Arapahoe
Ridge member at any annual member meeting or meeting called for the purpose of
amending the Declaration, Bylaws, or Rules and Regulations, provided that at
any member meeting there is a quorum present. Additional Rules and Regulations
may be adopted from time to time as needed.

- 4.01 Overnight Parking
- A homeowner of a lot is presumed in violation of Covenant 3.29
No Overnight On-Street Parking if a vehicle is parked on the street
in front of said lot any time between the hours of 2:00-5:00 a.m.
- 4.02 Parking Within Lots
- A homeowner of a lot is in violation of Design and Review
Guidelines if a vehicle is parked on said lot outside of the confines of the
garage or beyond paved or concreted area of the lots driveway.
- 4.03 Political Signs
- Political signs not exceeding 24x 36 shall be
exempt from the requirements of Covenant 3.14 Restrictions on Signs and
Advertising during the twenty (20) day period immediately preceding any
general election and on the day of any general election.
- 4.04 Document Inspection
- Document inspection shall be conducted according to a written
Policy adopted by the Board of Directors. The Policy is available by
request.
- 4.05 Change of Tenant
- In order to facilitate compliance with the Arapahoe Ridge
Homeowners Association governing documents, it is required that upon change of
tenancy, a homeowner shall notify ARHOA management of such change within thirty
days and shall provide a copy of the Declaration, Bylaws, and Rules and
Regulations to the new occupants upon tenancy.
- 4.06 Petty Cash Account
- The president of the Arapahoe Ridge Homeowners Association has
authority to make expenditures of up to $500 for HOA purposes, without prior
BOD approval. The president is required to notify the BOD of each
expenditure.
- 4.07 Fines
- Fining for violations shall be according to a written policy
adopted by the Arapahoe Ridge BOD. The policy is available upon request.
- 4.08 Plot Plan Submission:
- Per Design Review Committee Architectural Approval Covenant
4.5, a plot plan must be submitted to the DRC prior to commencement of work to
accomplish any proposed improvement to property. A plot plan is a legal
document showing property lines, the placement of your house within those
property lines, all utility easements, distances to property lines, lot and
block information, address, etc. Each homeowner should have received a copy of
their plot plan at closing (see the DRC page of the web site for an example of
a plot plan). If you did not receive one you can check with the Town of Erie
Building Department. If you do not have one, and cannot obtain one from the
town, please contact the DRC for assistance. It is important to the DRC to have
this document when changes are being made to your landscaping to ensure
easements and grading are not obstructed or compromised.

Restrictions for Arapahoe Ridge: 8.15 Power to Adopt Rules and
Regulations. The Association may adopt, amend, repeal, and enforce Rules
and Regulations as may be deemed necessary or desirable with respect to the
interpretation and implementation of this Declaration, the operation of the
Association, the use and enjoyment of Association Properties, and the use of
any other property within the Common Interest Community, including Lots. Any
such Rules and Regulations shall be effective only upon adoption by resolution
of the Board of Directors. Notice of the adoption, amendment, or repeal of any
Rule or Regulation shall be given in writing to each Member at the address for
notices to Members as elsewhere provided in this Declaration or the Bylaws, and
copies of the currently effective Rules and Regulations shall be made available
to each Member upon request and payment of the reasonable expense of copying
the same. Each Member shall comply with such Rules and Regulations and shall
see that Persons claiming through such Member comply with such Rules and
Regulations. Such Rules and Regulations shall have the same force and effect as
if they were set forth in and were part of this Declaration. In the event of
conflict between the Rules and Regulations and the provisions of this
Declaration, the provisions of this Declaration shall prevail. |
